NSA Says It\u2019s Too Large, Complex to Comply With Court Order<\/h1>\n<div class=\"post-date\" style=\"color: #7d7d7d;\">In an era of too-big-to-fail banks, we should have known it was coming: An intelligence agency too big to rein in \u2014 and brazen enough to say so.In a remarkable<a href=\"https:\/\/www.eff.org\/cases\/jewel\" target=\"_blank\"> legal filing on Friday afternoon<\/a>, the NSA told a federal court that its spying operations are too massive and technically complex to comply with an order to preserve evidence. The NSA, in other words, now says that it cannot comply with the rules that apply to any other party before a court \u2014 the very rules that ensure legal accountability \u2014 because it is too big.<\/p>\n<p>The filing came in a long-running lawsuit filed by the Electronic Frontier Foundation challenging the NSA\u2019s warrantless collection of Americans\u2019 private data. Recently, the plaintiffs in that case have fought to ensure that the NSA is preserving relevant evidence \u2014 a standard obligation in any lawsuit \u2014 and not destroying the very data that would show the agency spied on the plaintiffs\u2019 communications. Yet, as in so many other instances, the NSA appears to believe it is exempt from the normal rules.<\/p>\n<\/div>\n<\/blockquote>\n<\/header>\n<blockquote>\n<p style=\"color: #373737;\"><a href=\"https:\/\/www.eff.org\/cases\/jewel\" target=\"_blank\">In its filing on Friday<\/a>, the NSA told the court:<\/p>\n<\/blockquote>\n<blockquote style=\"color: #373737;\"><p>[A]ttempts to fully comply with the Court\u2019s June 5 Order would be a massive and uncertain endeavor because the NSA may have to shut down all databases and systems that contain Section 702 information in an effort to comply.&#8221;<\/p><\/blockquote>\n<blockquote>\n<p style=\"color: #373737;\">For an agency whose\u00a0<a style=\"color: #1982d1;\" href=\"http:\/\/fullcomment.nationalpost.com\/2014\/05\/02\/glenn-greenwald-the-nsas-collect-it-all-mission\/\" target=\"_blank\">motto<\/a>\u00a0is \u201cCollect It All,\u201d the NSA\u2019s claim that its mission could be endangered by a court order to\u00a0<em style=\"font-style: italic;\">preserve<\/em>\u00a0evidence is a remarkable one.
